The NBA legend Tells Court He ‘Wasn’t Afraid’ of Nascar in Legal Battle

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over alleged violations of competition laws.

Team Investment and a Competitive Drive

Jordan shared financial and corporate details of his racing venture, revealing he put in $40m of his own funds into the Nascar Cup series team launched with business partner Curtis Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan stated during testimony. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. I felt as far as the sport it needed to be looked at from a different view.”

Central Issue: Charter Agreements and Renewal Demands

At issue is the end of a 2016 deal where Nascar provided each team a “charter”. This system mirrors other professional sports with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar insisted on teams renew their charters.

Jordan was on the witness stand for an hour and exited the courthouse to pandemonium, with onlookers and reporters clamoring for a view or a picture of the sports legend.

Spearheading the Fight

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan said is breaking the law to keep two hands on the wheel.

For Jordan and and Heather Gibbs, who preceded Jordan, are events from September 2024. She recounted a hectic and tense period where the racing circuit told teams they had to sign a charter agreement extension. The document consists of over a hundred pages detailing team compensation and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan said that his team and its ally decided their sole viable path was to refuse a signature that 112-page package and litigate the matter. All other teams agreed to the terms.

The team owners reached out to Nascar about potential amendments or extension options. Nascar wasn’t talking, according to his testimony.

The Ultimate Motivation: Victory

But in the end, the pushback against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.

“Denny convinced me getting a third driver improved our chances to win,” he testified, noting that he purchased another franchise last year for $28m despite the uncertainty. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She testified the timing of the contract signing demand was problematic.

She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader refused the appeal.

“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. The response was, “If I wake up and I have 20 charters, that’s what I have. If there are 30, that’s the number.”
